What is an on-the-job injury?

An on-the-job injury can be a fall or carpal tunnel syndrome. It can also be an illness that you contract as a result of where you work. Here are some more examples to give you a better idea of what can be considered on-the-job injuries:

• Asbestos Exposure: exposure to asbestos can lead to asbestosis (a chronic incurable inflammatory condition of the lungs) or mesothelioma (lung cancer related to asbestos exposure)

• Slip and Fall: icy sidewalk, unmarked obstacles in the walkway, poor lighting, insufficient handrails, faulty equipment (i.e., scaffolding, etc.)

• Machine Accidents: getting caught in machines while they are running

• Hits: getting hit by an object or machine (i.e., overhead cranes moving supplies, etc.)

• Back Injuries: lifting/carrying loads that are too heavy, lifting improperly, overreaching, stretching, bending, twisting


Where can an on-the-job injury occur?

On a boat. On a train. On dry land or on a plane. With apologies to Dr. Seuss, you can sustain an on-the-job injury no matter where you work. The difference in how the injury claim would be handled is based on what industry you were working in when the accident happened. For most dry land jobs, you would probably file a workers’ compensation claim. However, railroad workers have the Federal Employers’ Liability Act (FELA) that governs the handling of on-the-job injury claims. For those who make their livelihood aboard sea-going vessels, the Merchant Marine Act (Jones Act) and the Longshore and Harbor Workers’ Compensation Act (LHWCA) would govern the process.

No matter where you work or how you were injured, your ability to continue working – both now and in the future – can be compromised based on the severity of your injury. It is recommended that you find a highly qualified attorney that understands workers’ compensation, FELA, LHWCA or any other regulations that might apply. You shouldn’t be penalized for being hurt while you were at work.
