Criminal record checks are regularly undertaken by employees and organisations to access important information regarding a potential employee’s background. A large number of professions require a criminal record check for the purpose of safety, and may be given access to necessary information under the Exceptions Order to the Rehabilitation of Offenders Act 1974.

The Criminal Records Bureau (CRB) offers two types of criminal records check. A standard criminal records check is carried out for such professions as legal, accountancy, security and so on. The standard check reveals any past warnings, cautions, reprimands or convictions registered on the Police National Computer of England and Wales.

The Enhanced criminal records check must be carried out for those in positions of trust, who work regularly with children or vulnerable adults. This can be anything from care work, teaching, activity leading, training, supervising and similar professions. Enhanced checks are the same as standard checks with the addition of ‘barred list’ data and local police information that might be relevant to the job role in question.

Even if you employ positions that do not require mandatory CRB checks, you can still apply criminal records checks when investigating candidates. Be aware that it must be referred to in the contract of employment; otherwise the employee has the right to refuse.
