One thing that is often not talked about when it comes to professional negligence claims is the stress that can be associated with the process of taking a professional negligence claim. It sounds as if it should be really straightforward, but in fact it is actually a stressful process.

It is likely that a legal professional negligence claim will not be agreed by both the parties. The professional will say that they have not been negligent and the individual who engaged them will say that they have indeed been negligent (which is why they are making a claim).

These discussion can be stressful. Both parties obviously want to 'win' the claim, but ultimately there can only be one party who is successful. So the whole process of a professional negligence claim is one that is adversarial in its approach. If this process was mutually beneficial then both parties would feel some gain, however this is not the case and there can only be one winner.

In addition to this stress there is often stress associated with financial loss. As well as this the financial loss could be so bad that it leaves the individual in a state. So there may be much resting on the professional negligence claim; it could make or break the individual or the business they represent.

There may also be transferred anxiety and stress. The professional who is fighting a negligence claim will probably be quite stressed and anxious, so even if the other party started off relatively calm, this stress may well be contagious and be passed from the professional onto the individual.

One way of taking control of the stress and emotion is to appoint an experienced professional negligence lawyer who will deal with your case and take on the stress for you. Obviously this means that the individual has to choose their negligence solicitor with care, but it is an important fact to bear in mind. If taking a professional negligence claim were completely stress free cases and claims would be taken at the drop of a hat, but alas, they are not and so choose your negligence solicitor with care!
