There are nine chapters of the Bankruptcy Code (Section 1 General Provisions; Page 3 Case Administration; Section 5 Creditors, the Debtor, and the Estate; Section 7 Liquidation; Chapter 9 Adjustment of Debts of an Municipality; Chapter 11 Reorganization; Chapter 12 Adjustment of Debts on the Family Farmer or Angler with Regular Annual Income; Chapter 13 Adjustment of Debts of Individual with Regular Income and Chapter 15 Ancillary and other Cross-Border Cases. Tangerine County California, Vallejo Ca, Harrisburg Pennsylvania and Jefferson County are the most recent and high profile cities to file bankruptcy. States are certainly not allowed to file personal bankruptcy, but municipalities within a state is a debtor and seek the reorganization of their debts.

Chapter 11 in the Bankruptcy Code provides for the reorganization of debts for individuals and businesses that have over $360, 475 in unsecured debts or $1, 081, 400 in secured debts. A Chapter 11 plan involving reorganization is proposed together with voted on by collectors.

Chapter 12 of the Bankruptcy Code provides for the Adjustment of Debts on the Family Farmer or Fisherman with Regular Income. Without a doubt, farmers and fisherman have their own section of the Personal bankruptcy Code.

Chapter 13 offers the Adjustment of Debts of an Individual with Regular Income. Chapter 13 allows somebody or small business to reorganize their debts if their unsecured debts are as few as $360, 475 and lower than $1, 081, 400 in secured debts. So if you have a lien that combined with all the other senior liens on the property and your exemptions relating to the property exceed what your home is worth, you can avoid the lien from the judgment avoiding it from your property or home. Even if your property or home is underwater and there's no equity to exempt you can still apply an exemption and avoid the judgment lien. This can be a jurisdictional issue that ought to be researched in your legal system though. The majority of the courts indicate that you can still avoid a judgment lien even if no exemptions are getting impaired. The lien only must impair an exemption that debtor could have maintained. Remember, only non-consensual liens being a judgment lien can be avoided under Chapter 7 personal bankruptcy, not consensual liens enjoy mortgages.
