Can you trust anybody to negotiate your mortgage modification? - By: Billy Alverado

Everyday in the news there is a mention of another dishonest 'negotiation agency' being sued by an Attorney General. While it is of the utmost importance that these scams be investigated the question that has to be asked is, are all these announcements of fraud causing the distressed homeowner to distrust any negotiation company?

The more we hear about dishonest agencies the more likely we are to group everyone into this category. But truth is that while the market has obliterated with scam artist taking advantage of the concerned homeowner there are legitimate services out there who are trying to make a living representing a homeowner who is faced with possible foreclosure. The more these scams are exposed the more difficult it becomes for us to trust anyone.
Certainly these companies that want your upfront money and then run should be stopped, but how do we stop these guys and still make the homeowner aware that there are reputable agencies out there that can help represent them in mortgage modification negotiations?

In order to put a stop to the fear mongering that is currently occurring we need to identify what makes up a legitimate agency. While the press has inundated us with negative press it is important that we realize that there are foreclosure services that are not fraudulent.

If you are facing possible foreclosure it would do you good to consider the following points when looking for a foreclosure service.

1. Avoid an agency that requires a large upfront fee - Some agencies will charge up to $8,500 to negotiate on your behalf. Some agencies will also keep ½ your money if they FAIL TO REACH AN AGREEMENT with the mortgage company. If you could afford to give them half for failing to negotiate you would not need them in the first place. In most states only a certified attorney may charge fees upfront for negotiation services.

2. Do not select an agency that is prone to accepting the first offer from the lender- It will do you no good to modify your mortgage if you are still not able to make the payments.
